These terms are an agreement between you and Warhawk Division, an unincorporated gaming community run by volunteers ("Warhawk Division", "we", "us"). They cover this website and everything on it. Please read them. They include a disclaimer of warranties and a limit on our liability in sections 12 and 13.
1. Agreeing to these terms
By using this site you agree to these terms and to our Privacy Policy. By signing in you confirm that agreement. If you do not agree, do not use the site.
2. Who can use the site
- You must be at least 16 years old.
- If you are under 18, or under the age of majority where you live, you may use the site only with the permission of a parent or guardian, who agrees to these terms on your behalf.
- You must follow Discord's own terms, because signing in runs through your Discord account.
- You may not use the site if we have banned you, or if the law where you live does not allow it.
3. Your account
You sign in with Discord. We do not create a separate password. You are responsible for what happens under your account, so keep your Discord account secure and tell staff if you think someone else has used it.
Your role on this site follows your roles in our Discord server and can change when they change. Ranks, units, and titles are part of the game: they give you no legal status, no employment, and no ownership in anything. Staff and admins must have two factor authentication switched on in Discord.
You can delete your account at any time in your settings.
If you link your game account, kills and deaths recorded on our game servers form your service record, which other members can see. Link only game accounts that are yours.
4. Community rules
The unit's rules are part of these terms: Commander's Intent and Operations Policies and In-Game Rules. On top of those, you agree not to:
- post or link to anything illegal, or anything that sexualizes minors in any way;
- harass, threaten, or demean anyone, or post hateful content about a person or group;
- post sexually explicit or gratuitously violent real world content;
- share another person's private information without their consent;
- impersonate another person, a staff member, or any real organization;
- post content you have no right to post, including content that infringes copyright or trademark;
- cheat, exploit, or share cheats for any game or server;
- send spam, advertising, or malware;
- collect other people's data from the site, or scrape it by automated means;
- probe, overload, or bypass the site's security, or use it to break into anything else;
- help a banned person get around a ban.
5. Your content
You keep ownership of what you post: forum posts, images, captions, your profile, applications, and anything else ("your content").
By posting it you give Warhawk Division a worldwide, royalty free, non-exclusive license to host, store, copy, resize, format, display, and distribute your content on this site and in our Discord server, for the purpose of running the community. This license lasts for as long as the content is on the site. When you delete your account your forum posts, published guides, and gallery uploads stay, with your name removed, so that conversations and the Field Manual remain readable. For those, the license continues. You can ask staff to remove specific items.
You promise that you have the right to post your content, that it breaks no law and nobody's rights, and that it follows these terms. When you upload a picture, add a video, or send in a guide, the site asks you to confirm this again: that it is yours to share and is not illegal, someone else's copyrighted work, or explicit. Anything you post in a public area can be seen, copied, and indexed by search engines, and we cannot pull it back from other people once it is out. Do not post anything you need to keep confidential.
This is a public, community run forum. You have no expectation of privacy or confidentiality in anything you post, upload, or do in it, including in members only and staff areas, which staff can read in full. The Privacy Policy says what we collect and what we do with it. We promise nothing beyond that.
6. Moderation
We may remove or hide any content, time out, suspend, or ban any account, and refuse access to anyone, at any time, for any reason or none, with or without notice. We are volunteers. We do not review everything that is posted and we are not responsible for what other people post. Staff actions are recorded in an audit log.
If you believe a staff decision was wrong, raise it with a senior staff member in Discord. Their decision is final.
7. Copyright complaints
If you believe something on the site infringes your copyright, send a direct message to a staff member in our Discord server (invite link) with:
- a description of the work you own;
- the address of the page or item on this site that you say infringes it;
- your name and a way to reach you;
- a statement that you believe in good faith the use is not authorized, and that your notice is accurate;
- a statement that you are the owner or are authorized to act for the owner.
We will review it and remove what should be removed. We end the accounts of people who infringe repeatedly.
8. Our content
The site's design, text, and graphics belong to Warhawk Division or to the people who made them. You may view and share pages for personal, non-commercial use. You may not copy the site or its graphics for any other purpose without permission. Game names, logos, and other trademarks belong to their owners.
9. Not affiliated, not official
Warhawk Division is an independent gaming community. It is not affiliated with, sponsored by, or endorsed by Bohemia Interactive, the United States Department of Defense, or any military organization. Arma Reforger is a trademark of its respective owner.
The unit's memorandums, ranks, insignia, and titles are part of a game and are not government or military documents or appointments. The reference library links to publicly released publications at their official sources: nothing in it, and nothing else on this site, is official guidance, military training, or professional advice of any kind. Do not rely on anything here for real world safety, medical, legal, or tactical decisions.
10. Other services and links
The site depends on and links to services we do not control, including Discord, the game and its Workshop, BattleMetrics, and official publication sites. Their own terms and privacy policies apply to them, and we are not responsible for them.
Game servers, mods, and mod lists are provided by volunteers and third parties. Mods are downloaded from the Workshop to your own device. You join servers and install mods at your own risk.
Any tip link on this site goes straight to an individual volunteer on a third party platform. A tip is a gift to that person. It is not a payment to Warhawk Division, it buys nothing, and it changes nothing about how you are treated here. We do not handle the money and cannot refund it.
11. A free, volunteer service
The site is a hobby. It is free, it earns nothing, and it is run by volunteers in their spare time and at their own expense. There is no company behind it and no insurance covering it. We may change it, take features away, lose data, or shut it down at any time, with no notice and no obligation to you. Keep your own copies of anything you care about. You can download your data in your settings.
12. No warranties
To the fullest extent the law allows, the site and everything on it are provided "as is" and "as available", with no warranties of any kind, express or implied. That includes any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, and uninterrupted or error free operation. You use the site, the game servers, and any mods at your own risk.
13. Limit of liability
To the fullest extent the law allows, Warhawk Division and the people who run it (its owner, staff, volunteers, and contributors) are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or reputation, arising from or related to the site, its content, other users' conduct, the game servers, or these terms, however the claim is framed and even if we were told the loss was possible. This applies to claims of every kind, including claims based on our own negligence.
To the fullest extent the law allows, our total liability to you for everything arising from or related to the site or these terms is limited to 50 US dollars, including for claims based on our own negligence.
Some places do not allow some of these limits. Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud, or for death or personal injury caused by negligence where that rule applies. In those places the limits apply as far as the law permits.
14. Your responsibility to us
To the extent the law allows, you agree to defend and compensate Warhawk Division and the people who run it against any claim, loss, or cost (including reasonable legal fees) that results from your content, your use of the site, your breaking of these terms, or your violation of the law or of someone else's rights.
15. Ending this agreement
You can stop using the site and delete your account at any time. We can suspend or end your access at any time, as described in section 6. Sections 5, 8, 9, and 12 through 18 continue to apply after your access ends.
16. Changes to these terms
We may update these terms. When we do, we change the date at the top, and we announce changes that matter on the site or in our Discord server. If you keep using the site after a change takes effect, you accept the new terms. If you do not accept them, stop using the site and delete your account.
17. Disputes
If you have a problem with us, first send a direct message to a staff member in our Discord server (invite link) and give us 30 days to try to sort it out.
These terms are governed by the laws of Texas, without regard to its conflict of laws rules. Any dispute that we cannot settle informally must be brought in the state or federal courts located in Texas, and you and we both accept the jurisdiction of those courts. If you are a consumer, this does not take away any protection or any right to sue at home that the law of the country where you live says cannot be waived.
To the extent the law allows, you and we agree to bring claims only as individuals and not as part of a class or group action, and any claim must be brought within one year of the events it is based on.
18. General
These terms, the Privacy Policy, and the unit's rules are the whole agreement between you and us about the site. If a court finds part of these terms unenforceable, that part is limited as little as necessary and the rest stays in force. If we do not enforce a term, we have not given it up. You may not transfer your rights under these terms. We may transfer ours to whoever takes over running the site. The people who run Warhawk Division are protected by sections 12, 13, and 14 and may rely on them. Apart from that, these terms give no rights to anyone else.
